Town of Jerusalem - Definitions

ACCESSORY BUILDING

A building detached from and subordinate to a main building, on the same lot and used for purposes customarily incidental to those of a main building.

ACCESSORY FACILITIES OR EQUIPMENT

Any structure, other than a CWECU, related to the use and purpose of deriving or distributing energy from such towers located at or near the CWECS site.

ACCESSORY STRUCTURE

A structure detached from and subordinate to a main structure or building on the same lot and used for purposes customarily incidental to those of the main structure or building.

ACCESSORY USE

A use customarily incidental to the principal use of a building. In buildings restricted to a residential use, the office of a professional person, customary family occupations and workshops not conducted for compensation shall be deemed "accessory uses."

ADULT ENTERTAINMENT BUSINESS

This term shall include adult use, adult use business or adult entertainment or those businesses distinguished or characterized by an emphasis on the depiction of or description of specified sexual activities or specified anatomical areas, including but not limited to an adult arcade, adult cabaret, adult media, adult media outlet, adult motel, adult motion-picture theater, adult mini-motion-picture theater, escort agency, sexual encounter center and/or any other commercial establishment where a portion of the principal business is of an adult nature or use.

The term "adult entertainment business" shall not include an establishment where a medical practitioner, psychologist, psychiatrist, or similar professional person licensed by the state engages in medically approved and recognized sexual therapy.

AGRICULTURE

The production of crops, and/or livestock and livestock products, as those terms are defined at § 301 of the New York State Agriculture and Markets Law.

AGRICULTURE USE

Land used for the production of crops and/or livestock and livestock products (as those terms are defined at Section § 301 of the New York State Agriculture and Markets Law).

ALLEY

A narrow service way providing a secondary public means of access to abutting properties.

ALTERATION

As applied to a building or structure, any change or rearrangement in the structural parts or in the exit facilities or any enlargement, whether by extending on a side or by increasing in height, or the moving from one location or position to another.

ALTERATION, STRUCTURAL

Any change in the supporting members of a building, such as bearing walls, columns, beams or girders.

ALTERNATE MEMBER

A person appointed by the Town Board to serve in place of a member who is unable to participate on an application or matter before the Zoning Board of Appeals, as provided herein.

ANIMAL HUSBANDRY

The keeping, grazing, feeding and care of animals other than household pets.

APARTMENT HOUSE

A building arranged, intended or designed to be occupied by three or more families living independently of each other.

APPLICANT

Any person applying to develop, own, locate, construct or operate a wind energy conversion system within the Town. All requirements placed upon an applicant under this article or by way of approval of a permit issued hereunder shall be fully and completely binding upon the owner, his/her/its successors, heirs and assigns of the wind energy conversion system being submitted for review hereunder.

AREA

The total area within the property lines excluding the external street.

AREA, BUILDING

The total of areas taken on a horizontal plane at the main grade level of the principal building, exclusive of all accessory buildings and exclusive of uncovered porches, terraces and steps. All dimensions shall be measured between the exterior faces of walls.

AUTO COURT

A building or group of buildings, whether detached or in connected units, used as individual sleeping or dwelling units designed primarily for transient automobile travelers and providing accessory off-street parking facilities. The term "auto court" includes buildings designated as tourist courts, motor lodges, motels and similar structures.

AUTOMOBILE SERVICE STATION

Any area of land, including structures thereon, that is used for the retail sale of gasoline or any other motor fuel and oil and other lubricating substances, including any sale of motor vehicle accessories, and which may or may not include facilities for lubrication, washing or otherwise servicing motor vehicles.

BANQUET FACILITIES

Any establishment operated for profit wherein the facilities are leased on a temporary basis for private wedding receptions, meetings, banquets, and other similar events. Such establishments shall not be open to the general public and may include food preparation facilities and areas for dancing, dining and other entertainment activities customarily found in association with banquets or receptions.

BASEMENT

A story partly below the average level of the adjoining ground, but having at least 1/2 of its height (measured from floor to ceiling) above the average level of the adjoining ground.

BEACHHOUSE or BATHHOUSE

An accessory building used for the sole purpose of storing miscellaneous items and beach furniture and accessories. It shall not be used for living quarters.

BED-AND-BREAKFAST

A single-family dwelling which is occupied by the owner and meets all of the following criteria:

A. At least three but not more than five sleeping rooms are offered by the owner for pay as overnight lodging facilities for not more than 10 transient guests.
B. Breakfast is the only meal provided.
C. The dwelling conforms to the New York State Uniform Fire Prevention and Building Code.

BELOW-REGULATORY CONCERN

Radioactive material in a quantity or of a level that is distinguishable from background (as that phrase is defined at 10 CFR 20.1003), but which is below the regulation threshold established by any regulatory agency otherwise having jurisdiction over such material in the Town.

BERTH

See "boat slip."

BILLBOARD

A sign or structure which directs attention to an idea, product, business activity, service or entertainment which is conducted, sold or offered elsewhere than upon the lot on which the sign is located.

BLADE GLINT

The intermittent reflection of the sun off the surface of the blades of a CWECU.

BOARDINGHOUSE

Any dwelling in which more than three persons, either individually or as families, are housed or lodged for hire with or without meals. A rooming house or a furnished rooming house shall be deemed a "boardinghouse."

BOAT

Any vessel, requiring State or Federal registration for use on public waters (including seaplanes).

BOAT ACCESSORY STRUCTURE

An enclosed storage structure, the purpose of which is the storage of boating-related accessories.

BOAT HOIST

Any mechanical device, the purpose of which is to raise or lift a boat out of the water for waterside storage.

BOAT HOIST STRUCTURE

A seasonal, open-sided, waterside structure containing a boat hoist.

BOAT SLIP

The area of any structure, boat hoist structure, boat station, boathouse, dock or pier, or any other facility, the purpose of which is the storage of one boat.

BOAT SLIPS and MOORING BUOYS

Any structure or buoy which is used for the purpose of parking a boat at or in the water, to include boat lifts.

BOAT STATION

A permanent, open-sided structure, constructed in the water with a mechanical device, the purpose of which is to raise or lift a boat out of the water for waterside storage. A boat station is intended as a permanent boat hoist structure and may have a roof.

BOATHOUSE

A one-story structure with no living quarters, open-sided or enclosed, which provides direct or indirect access to the water. No business, occupation or service is conducted for profit therein nor space herein leased to a nonresident of the premises.

BOATHOUSE

A permanent enclosed structure that provides direct water or rail access to Keuka Lake for boats. A boathouse has a permanent roof and one or more enclosed sides.

BREWERY

Shall have the definition as set forth in the New York State Alcoholic Beverage Control Law, as amended.

BUILDING

Any structure having a roof supported by columns or by walls and intended for the shelter, housing or enclosure of persons, animals or chattels.

BUILDING HEIGHT

The vertical distance measured from the average elevation of the proposed finished grade at the building's lowest side elevation to the highest point of the rooftop.

BUILDING INTEGRATED PHOTOVOLTAIC SYSTEM

A solar energy system consisting of a combination of photovoltaic building components integrated into any building envelope system, such as vertical facades including glass and other facade material, semitransparent skylight systems, roofing materials, and shading over windows.

BUILDING, DETACHED

A building surrounded by open space on the same lot.

BUILDING, PRINCIPAL

A building in which is conducted the main or principal use of the lot on which said building is situated. In any residential district, any dwelling shall be deemed to be the "principal building" on the use lot on which the same is located.

BUSINESS

Any person, firm, association, partnership, corporation or other entity for profit.

BUSINESS, LOW-IMPACT WHOLESALE

A small-scale limited retail business that manufactures or assembles products for sale off the premises or provides a service by electronic or other means that do not require the customer to come to the premises. In operation and appearance, it blends well with its surrounding neighbors.

BUSINESS, SMALL RETAIL SERVICE

Those businesses of a retail nature which provide a localized service to the public. Such businesses shall be small in nature and shall not be considered to be of a manufacturing or wholesale character. These businesses shall meet the special use conditions established in § 160-26.

CAMPGROUNDS

A parcel of land used or intended to be used, let or rented for transient and vacational and/or recreational occupancy by travel trailers, campers, tents, motor homes and the motor vehicles propelling or carrying the same, but excluding mobile homes designed for permanent occupancy or used as a place of residence.

CELLAR

A story partly underground and having more than 1/2 of its clear height below the average level of the adjoining ground. A "cellar" shall not be considered in determining the permissible number of stories.

CLUB

An organization catering exclusively to members and their guests, including premises and buildings for recreational or athletic purposes, which are not conducted primarily for gain, provided that there are not conducted any vending stands, merchandising or commercial activities except as required generally for the convenience of the membership and purposes of such "club."

CODE ENFORCEMENT OFFICER

The duly appointed official of the Town of Jerusalem charged with the duty of enforcing the provision of this chapter.

COMMERCIAL USE

A land use intended for the purpose of providing a product or service for a fee.

COMMERCIAL WIND ENERGY CONVERSION SYSTEMS (CWECS)

More than one CWECU designed to generate power only for transfer to a commercial utility grid including all structures and facilities utilized or necessary for the normal operation of the project being submitted by an applicant under this article, including, but not limited to, wind energy conversion units, all accessory facilities and equipment thereto, and/or any portion thereof.

COMMERCIAL WIND ENERGY CONVERSION UNIT (CWECU)

Any single mechanism designed for the purpose of converting wind energy into electrical energy, and transferring the energy to a commercial power grid. A CWECU is capable of producing one or more megawatts of power and does not produce power for on-site consumption. This definition shall include the tower, monopole, or other structure supporting the mechanism at its final working location. The height of a CWECU shall be considered the vertical distance as measured from the average elevation at the base of the structure to the tip of the highest point of the structure including all blades when at their apex position.

COMMERCIAL WIND FARM (CWF)

A commercial enterprise consisting of one or more CWECS located and attached as a group to the commercial utility grid.

COMPREHENSIVE PLAN

The Comprehensive Plan adopted by the Town Board of the Town of Jerusalem for the future preservation and development of the Town pursuant to § 272-a of the New York State Town Law, as the same may from time to time be amended, updated, and supplemented, including without limitation by planning policy statements, goals, and standards adopted by the Town Board.

COURT

An unoccupied open space, other than a yard, on the same lot with a building, which is bounded on two or more sides by the walls of such building.

COURT, OUTER

A court enclosed on not more than three sides by exterior walls and lot lines on which walls are allowable, with one side or end open to a street, driveway, alley or yard.

COVERAGE

That percentage of the plot or lot area covered by the buildings or structures, including accessory buildings and structures. All buildings and structures will count towards coverage and all portions of each building and structure shall be taken into consideration, including the open porches, decks and steps.

CUSTOMARY HOME OCCUPATION

See "home occupation."

DECOMMISSIONED

Status applied to a wind energy conversion unit when it has been nonproductive for a period of one year, or when the unit or project no longer provides a useful service.

DENSITY

The number of living units permitted per gross acre of land, exclusive of lands lying within the boundary of any public highway.

DEVELOPMENT

All structures, uses or other alterations or modifications of the natural landscape occurring above or below ground or water on a particular lot.

DEVELOPMENT BUFFER

An area of natural or new vegetation or man-made construction, which provides a visual and dimensional separation between dissimilar land uses.

DISTILLERY

Shall have the definition as set forth in the New York State Alcoholic Beverage Control Law, as amended.

DISTRICT

Any one of the areas shown on the Zoning Map of the Town of Jerusalem, into which the Town has been divided for the purposes of this chapter.

DOCK

Any water-dependent structure, or fixed platform built on floats, columns, open timber, metal, piles, or similar openwork supports, or cantilevered structures extending to the shore, including piers and wharfs, whose purpose is providing riparian access and/or securing of watercraft. All such structures, as above described, which are placed waterside of the mean high water mark shall be defined as a dock.

DOG KENNEL

Any land or structure where any number of dogs is kept for the purpose of sale or for boarding, care or breeding for which a fee is charged or paid.

DRIVE-IN EATING OR DRINKING ESTABLISHMENT

Any eating or drinking establishment which is designed for the consumption of food or beverages outside of an enclosed dining room.

DUMP

A lot of land or part thereof used primarily for the disposal, by abandonment, dumping, burial, burning or any other means and for whatever purpose, of garbage, sewage, trash, refuse, junk, discarded machinery, vehicles or parts thereof or waste material of any kind.

DWELLING UNIT

A building or portion thereof providing complete housekeeping facilities for one family.

DWELLING, DUPLEX

A building having two dwelling units.

DWELLING, GROUP

Two or more dwellings located on one parcel of land.

DWELLING, MULTIPLE

A building containing more than one dwelling unit.

DWELLING, ROW

One building consisting of a series of noncommunicating dwelling units.

DWELLING, SEASONAL

A detached dwelling not used for permanent residence and not occupied for more than six months in each year.

DWELLING, SINGLE-FAMILY

A building containing one dwelling unit.

EROSION CONTROL PLAN

A plan setting forth measures to protect slopes and unstable terrain from erosion and to prevent the accumulation of silt and sediment in drainage systems, streams, water bodies and on downstream properties.

ESSENTIAL SERVICES

The erection, construction, alteration or maintenance by public utilities or Town or other government agencies of underground or overhead gas, electrical or water transmission or distribution systems, communication systems, including poles, wires, mains, drains, sewer pipes, conduits, cables, fire alarm boxes, police call boxes, traffic signals, hydrants and other similar equipment, and accessories in connection therewith, reasonably necessary for the furnishing of adequate service by such public utilities or Town or other government agencies or for the public health, safety or general welfare, but not including buildings; provided, however, that "essential services" shall not mean or include natural gas compression facilities or natural gas processing facilities (as those terms are defined at § 160-141 of this chapter).

EXEMPTED VEHICLES

Any of the following:

(1) Vehicles for agricultural use;
(2) School buses or other mass transit buses;
(3) Emergency vehicles;
(4) Military vehicles driven by active duty military personnel; or
(5) Trucks used in the construction, repair or maintenance of state, county, or Town roads or other public structures or property.

EXPLICITLY PROHIBITED USES

The explicitly prohibited uses defined and described in § 160-141 of this chapter.

EXPLOSIVE MATERIALS

Substances capable of undergoing decomposition or combustion with great rapidity, involving much heat and producing a large volume of gas. The reaction products fill a much greater volume than that occupied by the original material and exert an enormous pressure, which can be used for blasting and for propelling. Examples include TNT, dynamite, nitroglycerin, and ammonium nitrate.

FALL ZONE

Fall zone shall be a level distance perpendicular to the base equal to the total height of the wind energy conversion unit plus the rotor at a full and upright vertical position.

FAMILY

One or more persons occupying the premises and living as a single housekeeping unit, as distinguished from a group occupying a boardinghouse, lodging house, club, fraternity or hotel.

FARM

The land, buildings and farm residential buildings used for the production of agricultural products as defined at § 301 of the New York State Agriculture and Markets Law.

FLAMMABLE

A solid, liquid or gas that will ignite easily and burn rapidly.

FLOOD AREA OF A BUILDING

The sum of the gross horizontal area of the several floors of a building, excluding attic, cellar and unfinished basement floor areas not devoted to residential use and the area of roofed porches and roofed terraces.

FLOOD or FLOODING

A general and temporary condition of partial or complete inundation of normally dry land areas from the overflow of streams, rivers or other inland areas of water or abnormally high tidal water or rising lake waters resulting from severe storms, hurricanes or tidal waves.

FLOOD PROTECTION ELEVATIONS

The one-hundred-year flood elevation.

FLOOD, ONE-HUNDRED-YEAR

The highest level of flood that, on the average, is likely to occur once every 100 years (i.e., that has a one-percent chance of occurring each year).

FLOODPLAIN AREA HAVING SPECIAL FLOOD HAZARDS

That maximum area of the floodplain that, on the average, is likely to be flooded once every 100 years (i.e., that has a one-percent chance of being flooded each year).

FLOODPLAIN MANAGEMENT

The operation of an overall program of corrective and preventive measures for reducing flood damage, including, but not limited to, emergency preparedness plans, flood control works and land use and control measures.

FLOODPLAIN or FLOOD-PRONE AREAS

A land area adjoining a river, stream, watercourse, ocean, bay or lake which is likely to be flooded.

FLOODPROOFING

Any combination of structural and nonstructural additions, changes or adjustments to properties and structures which reduce or eliminate flood damage to lands, water and sanitary facilities, structures and contents of buildings.

FLOODWAY

The channel of a river or other watercourse and the adjacent land areas required to carry and discharge a flood of a given magnitude.

GARAGE, PRIVATE

An enclosed space for the storage of one or more motor vehicles, provided that no business, occupation or service is conducted for profit therein and that space therein for not more than one car is leased to a nonresident of the premises.

GARAGE, PUBLIC

Any garage, other than a private garage, available to the public, operated for gain and which is used for storage, repair, rental, greasing, washing, servicing, adjusting or equipping of automobiles or other motor vehicles.

GATHERING LINE OR PRODUCTION LINE

Any system of pipelines (and other equipment such as drip stations, vent stations, pigging facilities, valve box, transfer pump station, measuring and regulating equipment, yard and station piping, and cathodic protection equipment), used to move oil, gas, or liquids from a point of production, treatment facility or storage area to a transmission line, which is exempt from the Federal Energy Regulatory Commission's jurisdiction under section 1(b) of the Natural Gas Act, and which does not meet the definition of a "major utility transmission facility" under the Public Service Law of New York, Article 7, § 120(2)(b).

GRADE, ESTABLISHED

The elevation of the center line of the streets as officially established by the Town authorities.

GRADE, FINISHED

The elevation of the completed surfaces of lawns, walks and roads brought to grades as shown on the plot plan filed with the building permit application.

GROSS VEHICLE WEIGHT RATING

The weight specified by the manufacturer as the maximum load weight (truck plus cargo) of a vehicle.

GROUND FLOOR SPACE

The floor area of the building measured three feet above the average grade level.

GROUND-MOUNTED SOLAR ENERGY SYSTEM

A solar energy system that is anchored to the ground and attached to a pole or other mounting system, detached from any other structure for the primary purpose of producing electricity for onsite consumption.

HEIGHT

The vertical distance measured from the mean high water level to the highest portion of a structure.

HIGH-FREQUENCY, HIGH-IMPACT TRUCK TRAFFIC

Any one of the following:

(1) More than 20 one-way trips by high-impact trucks to or from the site of the proposed use during any twenty-four-hour period at any time during the duration of the use; or
(2) More than 50 one-way trips by high-impact truck to or from the site of the proposed use during any seven-day period at any time during the duration of the use; or
(3) More than 700 one-way trips by high-impact truck to or from the site of the proposed use during any three-hundred-sixty-five-day period during the duration of the use.

HIGH-IMPACT TRUCK

A truck or tractor, as defined in the Vehicle and Traffic Law, with three or more axles, or ten or more wheels, and capable of hauling a gross vehicle weight of 34,000 pounds or more. High-impact truck does not include exempted vehicles.

HIGH-WATER MARK

Elevation above sea level of 715.15 feet.

HIGHWAY

Any state highway, county road or Town highway and, unless the context indicates otherwise, any street laid out on a filed subdivision map, which connects with a state highway, county road or Town highway. Unless the boundary of a highway is established at a width other than three rods or is defined by a legal description of record or by a wall, fence or other monument, the boundary of the same shall be presumed to be 24 3/4 feet from the center line of the traveled way.

HISTORIC QUALITY

Legacies of the past that are distinctly associated with physical elements of the landscape, whether natural or man-made, that are of such historic significance that they educate the viewer and stir appreciation of the past.

HOME OCCUPATION

An accessory use of a service character customarily conducted within a dwelling by the residents thereof, which is clearly secondary to the use of the building for living purposes and does not change the character thereof or have any exterior evidence of such secondary use other than one small sign on the premises in conformance with § 160-14B(1)(b). The office of a physician, surgeon, dentist or other professional person, including an instructor in violin, piano or other individual musical instrument limited to a single pupil at a time, who offers skilled services to clients and is not professionally engaged in the purchase or sale of economic goods shall be deemed "home occupations," and the occupation of dressmaker, milliner, seamstress, cosmetologist or real estate broker or salesman, each with not more than one paid employee, shall be deemed to be "home occupations."

Dancing instruction, tearooms, tourist homes, convalescent homes, mortuary establishments and stores, trades or businesses of any kind not herein excepted shall not be deemed to be "home occupations."

HOSPITAL

Unless otherwise specified, includes sanatorium, preventorium, clinic, rest home, nursing home, convalescent home and any other place for the diagnosis, treatment or other care of human ailments and shall be deemed to be limited to places for the diagnosis, treatment or other care of human ailments.

HOSPITAL, ANIMAL

Any structure where animals or pets are given medical or surgical treatment and where outside kennel runs or pastures are used incidentally to the principal use. This is differentiated from an animal clinic which is any structure where animals or pets are given medical or surgical treatment and where animals may be boarded or kenneled if incidental to clinical use. All kennels and runs must be part of the principal structure, enclosed and soundproofed.

HOTEL

A building containing rooms intended or designed to be used or which are used, rented, hired out to be occupied or which are occupied for sleeping purposes by guests and where only a central kitchen and dining room are provided within the building or in an accessory building.

ICE BREAKER

A permanent structure, usually composed of one or more pilings, installed for the exclusive purpose of protecting mooring and docking facilities from ice damage.

INJECTION WELL

A bored, drilled or driven shaft whose depth is greater than the largest surface dimension, or a dug hole whose depth is greater than the largest surface dimension, through which fluids (which may or may not include semi-solids) are injected into the subsurface and 90% or more of such fluids do not return to the surface within a period of 90 days.

The definition of "injection wells" does not include:

(1) Single-family septic systems that receive solely residential waste;
(2) Drainage wells used to drain surface fluids, primarily storm runoff, into the ground;
(3) Geothermal wells associated with the recovery of geothermal energy for heating or production of electric power; or
(4) Bore holes drilled to produce potable water to be used as such.

JUNKYARD

A lot, land or structure or part thereof used for the purpose of collection, storage and sale of wastepaper, rags, scrap metal or discarded material or for the collection, dismantling, storage and salvaging of machinery or vehicles not in running condition and for the sale of parts thereof.

KEUKA LAKE

That portion of the waters of Keuka Lake that is located within the jurisdiction of the Town of Jerusalem.

LAKE SHORELINE FOOTAGE

The number of feet of lake frontage based upon the Town or Village Tax Maps.

LAKESHORE OWNER

The person or persons having a fee simple title to the lakeshore parcel.

LAKESHORE PARCEL

A parcel of land bordering on the shore of Keuka Lake.

LAND APPLICATION FACILITY

A site where any natural gas and/or petroleum extraction, exploration or production wastes are applied to the soil surface or injected into the upper layer of the soil.

LARGE-SCALE SOLAR ENERGY SYSTEM

A solar energy system that is ground-mounted and produces energy primarily for the purpose of off-site sale or consumption.

LARGE-SCALE WATER USE

Any water withdrawal or sequestering water use of over 100,000 gallons of water in any thirty-day period from water resources within the Town. Large-scale water use does not include water withdrawn for agriculture use, for emergency uses such as fire fighting, or for drinking, recreational, cooking, washing, or sanitary purposes and used within the Town.

LAUNDERETTE

A business premises equipped with individual clothes washing machines for the use of retail customers, exclusive of laundry facilities provided as an accessory use in an apartment or an apartment hotel.

LIGHT INDUSTRY

The manufacture or assembly of finished products or parts predominately from previously processed or prepared materials (including fabrication, treatment, packaging, and incidental storage, and sale and distribution of such products or parts); provided that all operations are conducted entirely within an enclosed building, and provided, further, that such use does not produce or generate or otherwise involve on-site use or storage of natural gas and/or petroleum extraction, exploration or production wastes (as that term is defined in § 160-141 of this chapter); and does not involve high frequency, high-impact truck traffic, or any other explicitly prohibited use set forth in § 160-141 of this chapter.

LINE, STREET

The dividing line between the street, road or right-of-way and the lot. Where the "street line" is not readily determinable or has not yet been established, this line shall be made from the center of the existing traveled portion of the pavement or way for the purpose of this chapter. The three-rod right-of-way shall be used for computing the width of the street unless a different width has been established.

LIVING UNIT

A suite of one or more rooms designed for living and sleeping purposes and having a kitchen and bathroom for use of one family only.

LODGING HOUSE

A building in which three or more rooms are rented and in which no table board is furnished.

LOT

A parcel of land occupied or capable of being occupied by one building and the accessory buildings or uses customarily incident to it, including any open spaces as required by this chapter. A "lot" may be interrupted by a street or road. The area of the "lot," as computed for the purpose of this chapter, shall not include the area of the interrupting street or road.

LOT LINE, FRONT

The line separating the lot from the boundary of the highway or right-of-way upon which the lot abuts, except for all lots that border Keuka Lake, the "front lot line" will be the mean high water line of Keuka Lake.

LOT LINE, REAR

The lot line opposite and most distant from the front lot line. On lots that border Keuka Lake where a highway or right-of-way forms the rear lot line, the rear lot line shall be the boundary of the highway or right-of-way upon which the lot abuts.

LOT LINE, SIDE

The lot line(s) other than a front and/or rear lot line.

LOT, CORNER

A parcel of land at the junction of and fronting on two or more intersecting streets or bounded on at least two sides by streets or highways. All corner lots shall be deemed to have two front yards, two side yards and no rear yard.

LOT, DEPTH OF

That shortest distance between the front and rear lot lines as measured perpendicular to the street or highway or proposed street or highway shown on a subdivision map approved by the Planning Board, upon which said lot fronts. If the front line is not a straight line, the aforesaid measurement shall be perpendicular to the chord distance line of the front lot line.

MARINA

A lakeshore business, open to the general public, whose purpose shall include sale of boats, supplies and fuel; rental of boats, marine equipment, dock and mooring space, and winter storage; service of boats and marine equipment; and provision for boat access to the lake.

MEAN HIGH AND LOW WATER MARKS

The locations where the mean low and high water levels intersect with the shoreline of the lakeshore parcel.

MEAN LOW AND HIGH WATER LEVELS

The approximate average low water level or high water level for Keuka Lake, determined by reference from survey data provided by the United States Geological Service (USGS). According to the New York State Department of Environmental Conservation, Division of Environmental Permits, the mean high water level for Keuka Lake is 715.3. The mean low water level is 712.55.

MEMBER

A person appointed by the Town Board to serve on the Zoning Board of Appeals.

MINI STORAGE BUILDING

A building designed or used for the storage of personal belongings, as distinct from merchandise or commodities held for sale.

MOBILE HOME

See Chapter 104, Mobile Homes and Mobile Home Parks.

MOBILE HOME PARK

See Chapter 104, Mobile Homes and Mobile Home Parks.

MOORING

A waterside structure where vessels can be stored, including, but not limited to, dockage, boat slips, boat stations, boathouses, boat hoists, marine rail systems and buoys.

MOORING AND BERTHING FACILITY

A waterside area consisting of one or more structures, docks, mooring buoys or a combination thereof, used for the berthing or mooring of boats, yachts, or other floating craft, whether manually, mechanically, or sail powered.

MOORING BUOY

A floating object anchored to the bed of the lake, but not to the lakeshore, to which a boat could be attached for waterside storage.

MOTEL

See "auto court."

MOTOR VEHICLE REPAIR GARAGE

A building or portion of a building arranged, intended or designed to be used for making repairs to motor vehicles for profit.

MUSEUMS

A museum having a provisional or permanent charter from the New York State Board of Regents as an Education Corporation.

NACELLE

The portion of the wind energy conversion unit that connects the rotor to the support tower and houses the generator, gearbox, drive train and braking system.

NATURAL GAS

Methane and any gaseous substance, either combustible or noncombustible, which is produced in a natural state from the earth and which maintains a gaseous or rarefied state at standard temperature and pressure conditions, and/or gaseous components or vapors occurring in or derived from petroleum or other hydrocarbons.

NATURAL GAS AND/OR PETROLEUM EXPLORATION ACTIVITIES

Geologic or geophysical activities related to the search for natural gas, petroleum or other subsurface hydrocarbons including prospecting, geophysical and geologic seismic surveying and sampling techniques, but only to the extent that such activities involve or employ core, rotary, or any other type of drilling or otherwise making any penetration or excavation of any land or water surface in the search for and evaluation of natural gas, petroleum, or other subsurface hydrocarbon deposits.

NATURAL GAS AND/OR PETROLEUM EXTRACTION ACTIVITIES

The digging or drilling of a well for the purposes of exploring for, developing or producing natural gas, petroleum or other subsurface hydrocarbons, including without limitation any and all forms of shale fracturing.

NATURAL GAS AND/OR PETROLEUM EXTRACTION, EXPLORATION OR PRODUCTION WASTES

Any of the following in any form, and whether or not such items have been excepted or exempted from the coverage of any federal or state environmental protection laws, or have been excepted from statutory or regulatory definitions of "industrial waste," "hazardous," or "toxic," and whether or not such substances are generally characterized as waste: below-regulatory concern radioactive material, or any radioactive material which is not below-regulatory concern, but which is in fact not being regulated by the regulatory agency otherwise having jurisdiction over such material in the Town; crude oil or natural gas drilling fluids; crude oil or natural gas exploration, drilling, production or processing wastes; crude oil or natural gas drilling treatment wastes (such as oils, frac fluids, produced water, brine, flowback, sediment and/or any other liquid or semi-liquid material); any chemical, waste oil, waste emulsified oil, mud, or sediment that was used or produced in the drilling, development, transportation, processing or refining of crude oil or natural gas; soil contaminated in the drilling, transportation, processing or refining of crude oil or natural gas; drill cuttings from crude oil or natural gas wells; or any other wastes associated with the exploration, drilling, production or treatment of crude oil or natural gas. This definition specifically intends to include some wastes that may otherwise be classified as solid wastes which are not hazardous wastes under 40 C.F.R. 261.4(b). The definition of natural gas and/or petroleum extraction, exploration or production wastes does not include animal manure and/or recognizable and nonrecognizable food wastes, or waste generated by agriculture use.

NATURAL GAS AND/OR PETROLEUM EXTRACTION, EXPLORATION OR PRODUCTION WASTES DISPOSAL/STORAGE FACILITY

Any of the following:

(1) Tanks of any construction (metal, fiberglass, concrete, etc.);
(2) Impoundments;
(3) Pits;
(4) Evaporation ponds; or
(5) Other facilities, in any case used for the storage or treatment of natural gas and/or petroleum extraction, exploration or production wastes that:

(a) Are being held for initial use;
(b) Have been used and are being held for subsequent reuse or recycling;
(c) Are being held for treatment; or
(d) Are being held for storage.

NATURAL GAS AND/OR PETROLEUM EXTRACTION, EXPLORATION OR PRODUCTION WASTES DUMP

Land upon which natural gas and/or petroleum extraction, exploration or production wastes, or their residue or constituents before or after treatment, are deposited, disposed, discharged, injected, placed, buried or discarded, without any intention of further use.

NATURAL GAS COMPRESSION FACILITY

Those facilities or combination of facilities that move natural gas or oil from production fields or natural gas processing facilities in pipelines or into storage; the term shall include equipment for liquids separation, natural gas dehydration, and tanks for the storage of waste liquids and hydrocarbon liquids.

NATURAL GAS PROCESSING FACILITY

Those facilities that separate and recover natural gas liquids (NGLs) and/or other nonmethane gases and liquids from a stream of produced natural gas, using equipment for any of the following: cleaning or stripping gas, cooking and dehydration, residual refinement, treating or removing oil or condensate, removing water, separating NGLs, removing sulfur or carbon dioxide, fractionation of NGLs, or the capture of CO2 separated from natural gas streams.

NATURAL QUALITY

Those features of the visual environment, such as geological formations, fossils, landforms, water bodies, vegetation and wildlife that are in a relatively undisturbed state. There may be evidence of human activity but the natural features reveal minimal disturbances.

NONCONFORMING USE

A building or structure or use of land existing at the time of enactment of this chapter and which does not conform to the regulations for the use district in which it is situated.

NONREGULATED PIPELINES

Those pipelines that are exempt or otherwise excluded from regulation under federal and state laws regarding pipeline construction standards or reporting requirements; specifically includes production lines and gathering lines.

NUDITY or STATE OF NUDITY

The appearance of the human bare buttock, anus, anal cleft or cleavage, pubic area, male genitals, female genitals, or vulva, with less than opaque covering; or of a female breast with less than a fully opaque covering of any part of the areola; or of human male genitals in a discernibly turgid state even if completely and opaquely covered.

NURSERY SCHOOL

A school designed to provide daytime care or instruction for four or more children from two to five years of age, inclusive, and operated on a regular basis.

NURSING OR CONVALESCENT HOME

Any dwelling with sleeping rooms where persons are housed or lodged and furnished with meals and nursing care for hire.

OFF-SEASON BOAT STORAGE

The storage for hire or rental of inside storage space for boats in which any given boat is put into and removed from storage only once per year.

OPEN SPACE

Any unoccupied space exclusive of required yards, driveways and parking areas.

OPEN SPACE

Land that is not intensively developed for residential, commercial, industrial or institutional use, including but not limited to agricultural, forest, undeveloped shoreline, scenic and public parks and preserves. It may also include small vacant lots, community gardens and trails through developed areas.

OTHER LAND USES CATEGORY

All types of land uses on the lakeshore except those land uses specified in the residential land use category. This includes, but is not limited to, marinas, yacht clubs, camps, and restaurants.

PARKING SPACE

The area required for parking one automobile. For purposes of this chapter, it shall be an area 10 feet wide and 20 feet long, not including passageways.

PERMANENT

The type of construction for any dock, boathouse, boat station, or boat accessory structure that is fixed to the bed of the lake and not intended to be removed during the winter months.

PERSON

Any individual, proprietorship, firm, partnership, corporation, club, association or legal representative acting individually or jointly, limited-liability company, association or other legal entity.

PERSONAL WATERCRAFT

A vessel which uses an inboard motor powering a water jet pump as its primary source of propulsion and which is designed to be operated by a person sitting on, standing on or kneeling on the vessel rather than in the conventional manner of sitting or standing inside the vessel.

PIER or WHARF

My structure extending out into or over the water which is built upon fill.

PIPELINE

All parts of those physical facilities through which petroleum, natural gas, other gaseous substances, hazardous liquids, or chemicals move in transportation (including pipes, valves and other equipment and appurtenances attached to pipes and other equipment such as drip stations, vent stations, pigging facilities, valve boxes, transfer pump stations, measuring and regulating equipment, yard and station piping, and cathodic protection equipment) whether or not laid in public or private easement or private right-of-way within the Town. This term includes, without limitation, gathering lines, production lines, and transmission lines.

PLANNING BOARD

The Planning Board of the Town of Jerusalem.

PREEXISTING LOT

A lot that existed prior to the 1974 enactment of the Town of Jerusalem Zoning Ordinance.

PRIVATE CLUB

A membership-only nonresidential lakeshore facility, not associated with a unique multiple-residence upland property or properties, whose purpose is to provide social facilities for members and guests. It may include docking and mooring facilities for member- and club-owned boats.

PRIVATE WATER SYSTEM

A system for the provision of water for human or animal consumption through pipes or other constructed conveyances, where such system has fewer than 15 service connections or regularly serves fewer than 25 individuals.

PROJECT SITE

The entire parcel of land occupied, or to be occupied, by one or more townhouse groups and the land contiguous thereto devoted to related uses as required by this article.

PUBLIC UTILITY

A facility that provides electricity, gas, steam, telephone service, water or sewerage directly to the general public. For purposes hereof, a public utility is an entity which operates as a monopoly, and whose rates charged to customers are established by a utility commission.

QUADPLEX

Four one-story single-family residences, privately owned, leased or rented that have at least one common wall and occupying the same lot.

QUALIFIED SOLAR INSTALLER

A person who has skills and knowledge related to the construction and operation of solar energy equipment and installations and has received safety training on the hazards involved. Persons may be deemed to be qualified solar installers if the Town of Jerusalem determines such persons have had adequate training to determine the degree and extent of the hazard and the personal protective equipment and job planning necessary to perform the installation safely. Such training shall include the proper use of special precautionary techniques and personal protective equipment, as well as the skills and techniques necessary to distinguish exposed energized parts from other parts of electrical equipment and to determine the nominal voltage of exposed live parts.

QUARRY, SAND PIT, GRAVEL PIT, TOPSOIL STRIPPING

A lot of land or part thereof used for the purpose of extracting stone, sand, gravel or topsoil for sale, exclusive of the process of grading a lot preparatory to the construction of a building for which a building permit has been issued. In no event shall "quarry, sand pit, gravel pit, topsoil stripping" be construed to mean, be, or include natural gas and/or petroleum exploration activities or natural gas and/or petroleum extraction activities (as those terms are defined at § 160-141 of this chapter).

RADIATION

The spontaneous emission of particles (alpha, beta, neutrons) or photons (gamma) from the nucleus of unstable atoms as a result of radioactive decay.

RADIOACTIVE MATERIAL

Material in any form that emits radiation, but only if such material has been moved from its naturally occurring location through an industrial process. Such material is "radioactive material" for purposes hereof, whether or not it is otherwise exempt from licensing and regulatory control pursuant to the NYS Department of Labor, the US Nuclear Regulatory Commission, the US Environmental Protection Agency, the US Department of Energy, the US Department of Transportation, or any other regulatory agency.

REGULATORY AGENCIES

USDA (United States Department of Agriculture), NYS A&M (New York State Department of Agriculture and Markets) and/or NY PPBA (New York Professional Pet Breeder Association).

RESIDENTIAL LAND USE CATEGORY

All land uses on the lakeshore parcel that are normally classified as a place of dwelling, including, but not limited to, single-family, multi-family, and boarding houses, apartments, bed-and-breakfasts, townhouses and condominium units, time-shares, homeowner associations and multiresidence upland lakeshore parcels.

RESIDENTIAL STRUCTURE

Any permanent structure with electric power, running water and capable of inhabitation.

RESTAURANT

A business where food is prepared for, served to, sold to and consumed by patrons seated within an enclosed building or on the premises.

RIDING ACADEMY

Any establishment where horses are kept for riding, driving or stabling for compensation or incidental to the operation of any club, association, ranch or similar establishment.

RIGHT OF WAY

A strip of land acquired by reservation, dedication, forced dedication, prescription or condemnation and intended to be occupied by a road, crosswalk, railroad, electric transmission lines, oil or gas pipeline, water line, sanitary storm sewer, and other similar uses.

RIGHT-OF-WAY LINE

See "line, street."

ROADSIDE STAND

A stall or booth for business which shall be limited to the sale of agricultural products and incidental gift items.

ROADWAY BUFFER

The area of natural vegetation or landscaping, which is intended to provide a visual and dimensional separation between development and the closest right-of-way of Route 54A.

ROOF-MOUNTED SOLAR ENERGY SYSTEM

A solar energy system located on the roof of any legally permitted building or structure for the purpose of producing electricity for on-site or off-site consumption.

ROW HOUSE

A building consisting of a series of noncommunicating one-family sections having a common wall between each two adjacent sections with a straight unbroken front elevation and roof line. (Not allowed.)

RURAL VERNACULAR

Relating to, or characteristic of, the traditional building style or landscape of the countryside.

SCENIC CORRIDOR

A roadway and its accompanying right-of-way that offers motorists the unobstructed opportunity to view scenic views and scenic sites in one or more directions, and which usually has a high percentage of open landscape within and alongside it.

SCENIC RESOURCES

Those landscape patterns and features that are visually or aesthetically pleasing and that, therefore, contribute affirmatively to the definition of a distinct community or region, including, but not limited to, trees, rock outcroppings, and historic buildings. In case of a dispute as to whether a particular thing is a scenic resource within the meaning of this definition, the decision of the Planning Board shall govern.

SCENIC SITE

A building, structure, field, resource, natural condition or other feature that has scenic qualities and which has been specifically identified by the Town in the natural and historic resources element of its comprehensive plan or other inventory and assessment as worthy of protection because of its scenic qualities.

SCENIC VIEW

Scenic resources that can be seen from Route 54A and that lie more than 1/4 mile from Route 54A.

SCREEN

Natural vegetation or a decorative structure that creates an opaque visual block or obscures an unattractive view. Screening may consist of any combination of the following, as approved by the Planning Board:

A. Fencing constructed of cedar, redwood, treated wood, or other suitable all-weather material.
B. Masonry or stone walls.
C. Plant materials or natural vegetation.
D. Earthen berms.

SEASONAL

The type of construction for any dock or boat hoist structure that is intended to be removed during the winter months.

SEMINUDE or SEMINUDITY

A state of dress in which clothing covers no more that the genitals, pubic region and areola of the female breasts, as well as portions of the body covered by the supporting straps or devices.

SEQUESTERING WATER USE

Water that by virtue of the use in question is sequestered from the natural hydrologic cycle. This term does not include water that has evaporated, transpired, been consumed by humans or livestock, used for irrigating crops, or otherwise returned to the atmosphere or incorporated into food products.

SETBACK

The area of land measured along the ground out a horizontal distance in any direction from the structure or facility being regulated under this article.

SETBACK

The minimum distance by which any building or improvement must be separated from the right-of-way of Route 54A.

SETBACK, FRONT

The distance from the street line to the front wall or that part of the structure nearest the street line, measured at right angles or radially from the street line, not including steps or open porches. On corner lots, the "front setback" includes the distance from the street line to the wall of that part of the structure nearest each street line measured as above.

SETBACK, REAR

The distance from the rear lot line to the nearest part of the structure, measured at right angles or radially from the rear lot line.

SETBACK, SIDE

The distance from the side lot line to the nearest part of the structure, measured at right angles or radially from the side lot line.

SEXUAL ACTIVITIES

Any act of masturbation, sadomasochism, sexual intercourse or physical contact with a person's clothed or unclothed genitals, pubic area or buttocks.

SHADOW FLICKER

The effect from the sun shining through the turning blades of the wind energy conversion unit and casting a shadow over the landscape.

SIGN

Any structure or part thereof attached thereto or painted or represented thereon which shall display or include any letter, word, model, banner, flag, pennant, insignia, device or representation used as or which is in the nature of an announcement, direction or advertisement. The word "sign" includes the word "billboard," but does not include the flag, pennant or insignia of any nation, state, city or other political, educational, charitable, philanthropic, civic, professional, religious or like organization or campaign, drive, movement or event.

SIGN, ILLUMINATED

A sign having an artificial lighting device in connection therewith to attract attention or increase its visibility.

SOLAR ENERGY EQUIPMENT

Electrical energy storage devices, material, hardware, inverters, or other electrical equipment and conduit of photovoltaic devices associated with the production of electrical energy.

SOLAR ENERGY SYSTEM

An electrical generating system composed of a combination of both solar panels and solar energy equipment.

SOLAR PANEL

A photovoltaic device capable of collecting and converting solar energy into electrical energy.

SPECIAL USE

A use which because of its unique characteristics requires individual consideration through a procedure of review by the Board of Zoning Appeals, in order to determine whether a special use permit should be granted, conditionally granted, or denied.

SPECIFIED ANATOMICAL AREAS

These include:

A. Less than completely and opaquely covered: human genitals, pubic region, buttock and female breast below a point immediately above the top of the areola; and
B. Human male genitals in a discernible turgid state, even if completely and opaquely covered.

SPECIFIED SEXUAL ACTIVITIES

This term includes any of the following:

A. The fondling or other erotic touching of human genitals, pubic regions, buttocks, anus or female breasts, whether covered or uncovered;
B. Sex acts, normal or perverted, actual or simulated, including intercourse, oral copulation or sodomy;
C. Masturbation, actual or simulated;
D. Excretory functions as part of or in connection with any of the activities set forth in Subsections A, B and C above.

STABLE, PUBLIC

An accessory building in which any horses are kept for hire, remuneration or sale.

STORY

That portion of a building between the surface of the floor and the ceiling next above it, having a vertical distance of at least seven feet six inches along the studs forming each of the exterior walls. Each "story" above the first "story" must have an area equal to at least two-thirds (2/3) that of the first "story." The first "story" is the lowest "story" which is 75% or more above the average level of the ground adjacent to said building.

STORY, HALF

That portion of a building next under a gable, hip or gambrel roof having a vertical distance between floor and horizontal ceiling of at least seven feet six inches, except that, for habitable space under a sloping roof, the minimum height above at least 50% of such floor area shall be seven feet six inches, and the area where the height is less than five feet shall not be considered in computing required floor area.

STREET

A public way or proposed public way shown on a subdivision map approved by the Town Planning Board.

STREET GRADE

The officially established grade of the street upon which a lot fronts. If there is no officially established grade, the existing grade of the street shall be taken as "street grade."

STRUCTURE

Anything constructed or erected, the use of which requires location on the ground or attachment to something having location on the ground, including, but not limited to, retaining walls over four feet in height.

SUBSTANTIAL CONNECTION

A. In a sole proprietorship, an individual who owns, operates, controls or conducts, directly or indirectly, any premises, building, or location upon which any adult use takes place.
B. In partnership, limited or general, an individual who shares in the ownership or control of any of the assets of the partnership.
C. In a corporation, an individual who is an officer, director or holder, either directly or indirectly or beneficially, of more than 20% of any class of stock.

SUBSURFACE

Below the surface of the earth, or of a body of water, as the context may require.

SWIM FLOATS

Seasonal platforms, fastened to the lake bottom, whose purpose is to provide deeper water access for swimming and diving.

SWIMMING POOL

Any structure, except a farm pond, above or below ground designed for capacity of more than 18 inches of water depth.

TELECOMMUNICATION TOWER

Any structure greater than 35 feet in height, which is capable of receiving or transmitting wireless signals for the purpose of communicating information.

THEATER, OUTDOOR DRIVE-IN

An open lot or part thereof, with its appurtenant facilities, devoted primarily to the showing of moving pictures or theatrical productions on a paid admission basis to patrons seated in automobiles or on outdoor seats.

TIE LINE

The straight line extending between the two shoreline boundaries of a lakeshore property at the mean high water mark.

TIP HEIGHT

Tip height is equal to the distance from the ground to the tip of the rotor blade in a full and upright vertical position.

TOURIST HOME

A dwelling in which overnight accommodations are provided or offered for transient guests for compensation.

TOWER HEIGHT

Tower height is equal to the distance from the ground to the top of the tower not including the nacelle or rotor blades.

TOWER SITE

Site where one or more commercial wind energy conversion unit(s) will be located, including all accessory facilities or equipment.

TOWN BOARD

The governing board of the Town of Jerusalem.

TOWNHOUSE

A building consisting of a series of two or more noncommunicating one-family dwellings having a common fireproof wall between each two dwellings. The number of adjacent living units, the front elevations of which are in the same vertical plane, shall not exceed two and shall be set off at least 18 inches from the adjoining front. The "townhouse" shall have no more than six living units per structure.

TOWNHOUSE

A building that is one of a series of noncommunicating one-family dwelling units having a common party wall between units. Each unit has private outside entrances, separate front and rear yards and separate utilities and is located on a separate deeded lot.

TOWNHOUSE GROUP

A series of connected townhouses.

TOWNHOUSE LOT

The parcel of land on which a townhouse stands. It is part of the project site.

TRANSMISSION LINE

A pipeline that transports oil, gas, or water to end users as a public utility and which is subject to regulation either by the Federal Energy Regulatory Commission's jurisdiction under § 1(b) of the Natural Gas Act, or as a "major utility transmission facility" under the Public Service Law of New York, Article 7, § 120(2)(b).

UNDERGROUND INJECTION

Subsurface emplacement of natural gas and/or petroleum extraction, exploration or production wastes by or into an injection well.

UNDERGROUND NATURAL GAS STORAGE

Subsurface storage, including in depleted gas or oil reservoirs and salt caverns, of natural gas that has been transferred from its original location for the primary purpose of load balancing the production of natural gas. Includes compression and dehydration facilities, and pipelines.

USE

The specific purpose for which the land or buildings is designed, arranged or intended or for which it is or may be occupied or maintained. The term "permitted use" or its equivalent shall not be deemed to include any nonconforming use.

USE, NONCONFORMING

See "nonconforming use."

USE, SPECIAL

See "special use."

VARIANCE

An area variance or a use variance, as the context may admit.

VARIANCE, AREA

The authorization by the Zoning Board of Appeals for the use of land in a manner that is not otherwise allowed by the dimensional or physical requirements of the applicable zoning regulations.

VARIANCE, USE

The authorization by the Board of Zoning Appeals for the use of land for a purpose that is otherwise not otherwise allowed or is prohibited by the applicable zoning regulations.

VESSEL

A floating means of conveyance.

VIEWSHED

The surface area that can be seen from a specific viewpoint along Route 54A.

WATER OR WATER RESOURCES

All streams, ditches, lakes, ponds, marshes, vernal pools, watercourses, waterways, wells, springs, drainage systems, and all other bodies or accumulations of water, surface or underground, intermittent or perennial, which are contained in, flow through or border upon the Town or any portion thereof.

WATER RIGHTS LINES

Imaginary lines that extend into the lake in order to establish the riparian rights of adjoining lakeside properties. Water rights lines determine the boundaries for the placement of berthing and mooring facilities, as well as all other facilities subject to this article. The method for establishing water rights lines is found in § 160-122C.

WATER WITHDRAWAL

Removal or capture of water from water resources within the Town.

WATERSIDE

The lakeside of the mean high water mark.

WATERSIDE STRUCTURE

Any waterside man-made structure, for use in enabling water-dependent activities, whose profile is visible above the surface of the water and is affixed in some way to the shore or the lake bottom to hold its position.

WAY

A street or alley or other thoroughfare or public easement permanently established for passage of persons or vehicles.

WIND MEASUREMENT TOWER (WMT)

A tower installed for a temporary period of time to measure wind velocity, direction and duration.

WINERY

Shall have the definition as set forth in the New York State Alcoholic Beverage Control Law, as amended.

YACHT CLUB

A membership-only lakeshore facility, not associated with a unique upland property or properties, whose purpose is to promote, educate and regulate yachting and boating, as well as provide social facilities for members. The club facility may include docking and mooring facilities for member- and club-owned pleasure boats, limited marine supplies for member use, and clubhouse facilities for the use of members and guests.

YARD

An unoccupied space open to the sky on the same lot with a building or structure.

YARD, FRONT

A. Except as otherwise defined, the area between the part of an existing structure nearest the street line and the street line bounded on each side by the side lines of the lot.
B. On corner lots, those areas between that part of each exterior wall of an existing structure nearest each street line abutting said lot and said street line bounded by the other street, and the side line most closely parallel to said other street line shall be the "front yard."
C. For all lots that border Keuka Lake, the "front yard" will be the area between the part of an existing structure nearest Keuka Lake and mean high water line of Keuka Lake, bounded on each side by the side lines of the lot.

YARD, REAR

A. That area between that part of an existing structure nearest the rear lot line and the rear lot line of each lot.
B. For all properties that border Keuka Lake, the "front yard" will be the area between the part of an existing structure nearest Keuka Lake and the mean high water line of Keuka Lake, bounded on each side by the side lines of the lot.

YARD, SIDE

That area between that part of an existing structure nearest the side line and the side line of each lot, provided that such side line is not also a street line.

The Zoning Board of Appeals of the Town of Jerusalem as established by the Town Board pursuant to the provisions of § 267 of the Town Law.
